5.1 Right to Know

Under the CCPA, a “sale” occurs when personal information is rented, disclosed, transferred, or communicated to a third party for monetary or other valuable consideration. A business “shares” personal information when it transfers personal information to a third party for cross-contextual behavioral advertising purposes, whether or not for monetary or other valuable consideration. While we do not sell personal information for monetary consideration, certain sharing of data with third-party advertising or analytics partners (such as through cookies or tracking pixels) may constitute a “sale” or “sharing” under California law. To exercise any of the rights described above, please submit a verifiable consumer request by:
Emailing us at cameron@theroomnewport.studio
Calling us at (949)-200-3058
We will verify your identity before processing your request by matching information you provide to us with information we already have about you. You may also designate an authorized agent to make a request on your behalf, provided the agent is registered with the California Secretary of State (if applicable) and has your signed written authorization. We may still require you to verify your identity directly even when an authorized agent submits a request on your behalf.
We will respond to verifiable requests within forty-five (45) days of receipt. If we require additional time (up to an additional 45 days), we will notify you in writing of the reason and extension period. Any disclosures we provide will only cover the twelve (12) month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response. We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Appeals. If we deny your privacy rights request, you have the right to appeal that decision by contacting us using the contact information provided below. Please include “Privacy Appeal” in the subject line. We will respond to your appeal in accordance with applicable law.
California “Shine the Light” Law. California Civil Code Section 1798.83 permits visitors to our Services who are California residents to request certain information, once a year, regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send us an email at cameron@theroomnewport.studio and put “Shine the Light Request” in the subject line.
6. Data Retention
We retain personal information as long as necessary or relevant for the purposes for which it was collected. We also keep information for the period of time required by law. Specific retention periods include:

Marketing preferences: Retained until you opt out or withdraw consent.
Website usage data: Generally retained for up to twenty-four (24) months.
When personal information is no longer needed, we will securely delete or anonymize it.
7. Information Collection from Minors
Our Online Services are generally meant for adults. We do not knowingly collect personal information from children under thirteen (13) years old without permission from a parent or guardian. If you are a parent or legal guardian and think your child under thirteen (13) years old has given us information, you can email us at cameron@theroomnewport.studio and we will work to delete the information. Please mark your inquiries “COPPA Information Request.” With respect to minors who participate in Studio Services under our Membership Agreement: for group class participants aged sixteen (16) to seventeen (17), and for private or semi-private session participants of any age, we collect personal information only after a parent or legal guardian has signed the Membership Agreement and Liability Waiver on the minor’s behalf. The parent or guardian’s signature constitutes consent to our collection and use of the minor’s personal information as described in this Policy. Parents and guardians may contact us at any time to review, request deletion of, or withdraw consent for their child’s personal information.
8. Security Measures
We implement reasonable security measures to ensure the security of your personal information. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. We may post a notice via our website if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
We use reasonable organizational, technical, and administrative measures designed to safeguard your information against loss, theft, unauthorized use, disclosure, or modification. These measures include:
Encryption of sensitive data in transit and at rest
Secure payment processing through PCI-compliant third-party processors
Access controls limiting employee access to personal information on a need-to-know basis
Regular security assessments and monitoring
Of course, despite these measures, no network or system is entirely secure, and we cannot guarantee the security of networks and systems we operate or that are operated on our behalf.
9. Third-Party Sites and Links
If you click on a link to a third-party site from our Online Services, you will be taken to websites we do not control. This Policy does not apply to the privacy practices of these third-party websites or platforms. Read the privacy policy of other websites carefully. We are not responsible for these third-party practices.
10. Do Not Track Signals and Global Privacy Control
We do not currently take actions to respond to “Do Not Track” signals from browsers because a uniform technological standard has not yet been developed. However, we participate in Global Privacy Control (GPC). If you use a GPC-enabled browser or browser extension, we will treat your browser and device as opted out from any sale or sharing of personal information to the extent we engage in such processing. You may learn how to set up GPC by visiting https://globalprivacycontrol.org/.
You can opt out of receiving our marketing communications. To stop receiving our promotional content, follow the “unsubscribe” instructions in any promotional message you get from us. Even if you opt out of marketing messages, you may still receive certain communications from us relating to your account, bookings, schedule changes, and similar administrative, transactional, or service-related messages. You may also adjust your device or browser settings to disable, prohibit, or turn off automated technologies or location services features. Adjusting settings or deleting cookies in one device or browser will only apply to that device or browser. If you choose to limit collection of your information in these ways, certain Online Service features may not function properly.
SMS Privacy and Terms. If you opt in to receive text messages from us, you agree that we may send you recurring SMS messages related to your account, bookings, and studio services, including through the use of automated technology. Message frequency may vary, and message and data rates may apply. Contact your wireless provider for questions about your text plan or data plan. The SMS service is provided on an “as is” and “as available” basis, and carriers are not liable for delayed or undelivered messages. You can unsubscribe from text messages at any time by replying STOP to any message from us. After you send STOP, we may send one confirmation message, after which you will no longer receive SMS messages from us unless you re-subscribe.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Financial Incentive Programs. From time to time, we may offer referral credits, loyalty rewards, promotional discounts, or other programs that may be considered a “financial incentive” under the CCPA because they involve the collection or retention of personal information. If we offer such a program, we will provide you with a separate Notice of Financial Incentive at the time the program is made available, describing the material terms, the categories of personal information collected, and how we calculate the value of the incentive. Participation in any financial incentive program is voluntary, and you may opt in or withdraw at any time without penalty.
11. Policy Updates
We may make changes or updates to this Privacy Policy, and the updated Privacy Policy applies to you after the effective date stated in the revised Policy. If we change the Policy in a material way, we will provide appropriate notice to you, such as posting a prominent notice on our website, updating the “Last Updated” date, or emailing you if you have provided your email to us. Please check our site periodically for updates. Your continued use of our website or services after any changes constitutes your acceptance of the updated Policy.
